Article 2 — Scope
These GTCS apply to all sales of digital services concluded through the website growfrix.com between Growfrix Marketing and any natural or legal person (the “Customer”). They are accessible at any time on the website and prevail over any other document.
Growfrix Marketing reserves the right to modify these GTCS at any time. The version applicable to the Customer is that in force on the date of the order.
Article 3 — Description of services
Growfrix AI Studio is a software-as-a-service (SaaS) platform providing AI-powered productivity tools. The services offered for sale are:
- Individual AI tools — one-time purchase granting perpetual access to a specific tool (e.g. text generation, image generation, video generation, landing page builder, website audit, competitor intelligence, email marketing suite). Each tool is described on the Store page with its features, price and supported languages.

- The services are delivered digitally, online, immediately after payment confirmation. No physical good is delivered.
Article 4 — Price and currency
Prices are displayed in United States Dollars (USD) on the website. For customers within the European Union, Value Added Tax (VAT) at the applicable rate is added at checkout and clearly itemised on the invoice.
For B2B customers within the EU who provide a valid intra-community VAT number, VAT is not charged (reverse-charge mechanism).
Prices may be modified at any time. The price applicable is that in force at the time the Customer validates the order.
Article 5 — Ordering process
- The Customer browses the Store, selects the desired tool(s), and clicks the purchase button.
- A payment dialog summarises the order (description, quantity, unit price, total price, VAT if applicable) and requires the Customer to confirm the purchase.
- The Customer is required to accept these GTCS before completing the payment.
- Payment is made through a PCI-compliant payment service provider. Growfrix Marketing does not store full payment card numbers.
- The order is confirmed by the display of a success message and by the sending of a confirmation email to the address linked to the Customer's account.
- An invoice is generated automatically and is available for download from the Customer's dashboard.
Article 6 — Payment terms
Payment is due in full at the time of the order. The accepted payment methods are: credit card (Visa, Mastercard, American Express) and any other method displayed at checkout.
The transaction is secured by SSL encryption. The payment service provider is responsible for the security of the payment data.
In the event of a declined payment, the order is automatically cancelled and no amount is debited.
Article 7 — Delivery and access
The services are delivered digitally and are accessible immediately after payment confirmation. The purchased tool(s) appear in the Customer's “My AI Tools” library.
Access requires an internet connection and a modern web browser. Growfrix Marketing does not guarantee compatibility with outdated browsers or specific network configurations.
Article 8 — Right of withdrawal (consumers)
Pursuant to Articles L.221-18 et seq. of the French Consumer Code, a consumer (a natural person acting for purposes outside his or her trade, business, craft or profession) has a right of withdrawal of 14 (fourteen) calendar days from the conclusion of the contract, without having to give any reason.
Because the services are digital content supplied on an intangible medium and are made available for immediate use, the Customer is informed that, by validating the order and starting to use the Service within the 14-day period, he/she expressly requests immediate performance and acknowledges that the right of withdrawal will be lost once the service has been fully performed, pursuant to Article L.221-28, 13° of the French Consumer Code.
To exercise the right of withdrawal before the service has been performed, the Customer must send an unambiguous statement of his/her decision to withdraw to [email protected] or to the postal address of the registered office.
Article 9 — Refund policy
Growfrix Marketing wants every customer to be satisfied. If you are not happy with your purchase, we will refund you — no lengthy process, no unnecessary questions.
- You may request a refund within 14 days of purchase if you are not satisfied with the tool, or if the tool has not been used (no generation performed).
- Refund requests must be sent to [email protected] from the email address linked to your account, including the invoice number and the reason for the request.
- Our support team examines every refund request and responds within 24 hours.
- Once approved, refunds are processed to the original payment method within 5 business days (the exact time for the funds to appear in your account depends on your bank or card issuer).
- Before initiating a chargeback with your card issuer, please contact us so that we can resolve the issue directly. Unjustified chargebacks may lead to account suspension.
Article 10 — Legal guarantees
The services benefit from the legal guarantees of conformity (Articles L.217-4 to L.217-14 of the French Consumer Code) and against hidden defects (Articles 1641 to 1649 of the French Civil Code), where applicable.
For professional customers, Growfrix Marketing's liability is limited to direct damages and capped at the total amount paid by the Customer during the 12 months preceding the claim, except in cases of gross negligence or wilful misconduct.
Article 11 — Intellectual property
The Customer retains ownership of the inputs (prompts, images, text) submitted to the Service and — as between the Customer and Growfrix Marketing — of the outputs generated, subject to applicable law and any underlying third-party rights.
The software, interface, trademarks, logos and documentation of Growfrix AI Studio remain the exclusive property of Growfrix Marketing or its licensors. No licence beyond strict use is granted.
Article 12 — Personal data
Personal data collected during the sale is processed in accordance with the Privacy Policy and with the GDPR. The Customer has the right to access, rectify and delete their data, which they can exercise by contacting [email protected].
Article 13 — Complaints and mediation
For any complaint relating to an order, the Customer may contact [email protected]. Growfrix Marketing undertakes to respond within 10 business days.
In accordance with Articles L.612-1 and L.612-2 of the French Consumer Code, the consumer Customer has the right to refer the matter free of charge to a consumer mediator. The mediator designated by Growfrix Marketing is [to be designated]; contact details will be provided on request.

Article 14 — Governing law and jurisdiction
These GTCS are governed by French law.
In the event of a dispute, the Customer is invited to contact [email protected] in order to seek an amicable resolution.
Failing an amicable resolution, any dispute shall be submitted to the competent French courts. For professional customers, jurisdiction is given to the competent courts of the registered office of Growfrix Marketing, unless mandatory rules provide otherwise.
Article 15 — Contract language and archiving
These GTCS are written in English. In the event of a translation, the English version prevails.
The order data and these GTCS are archived on a durable medium (electronic) by Growfrix Marketing for the period required by applicable law and are accessible to the Customer via their dashboard.
